I. Types of Data We Collect
a. “Personal Information” means data that allows someone to identify an identifiable individual, including, for example, name, address, telephone number, email address, as well as any other non-public information about an individual that is associated with or linked to any of such identifying information. “Anonymous Information” means information that does not permit the identification of individual persons. We collect Personal Information and Anonymous Information, as described below.
II.How We Collect Data
We collect information about you in a range of ways.
a. Information You Give Us. We collect information from you when you submit any of the following through the Site: a referral, a request for a funding estimate or consultation, or an application for factoring services. This information includes, but is not limited to, your name, email address, mailing address, phone number, company name, business type and other information necessary for us to process such requests. If you submit an application for factoring services, we will ask you to submit additional information about yourself, your business and other owners or shareholders of your business. This information, includes but is not limited to, information about the organization, ownership structure, operating history and licensure of your business, the existence of outstanding loans, leases, factoring lines, revolving lines of credit or other obligations secured by the applicant’s assets, lending and insurance relationships, criminal history (including a background check), bankruptcy filings, tax IDs and other information that we need to evaluate your application for factoring lines and services. You are not required to provide this information to us, but you will not be able to submit referrals, requests for factoring rate quotes, requests for consultations, or applications for factoring lines and services if you decide not to submit this information. We also collect information about our transactions with you, including information about your payment history. In addition, we may make voice recordings of our telephone conversations with you.
b. Information We Collect From Others. We may collect information about you from other sources, such as credit bureaus and state departments of motor vehicles, to verify the information you provide to us and to assist us with processing requests for factoring quotes and applications for factoring services. We may combine this information with other information we collect through this Site.
c. Information Automatically Collected. To make our Site and services more useful, we automatically log information about you and your computer or device. For example, when visiting our Site, we log your computer operating system type, browser type, browser language, Internet Protocol address (a number that is automatically assigned to your computer when you use the Internet, and which may change), the website you visited before visiting our Site, pages you viewed, how long you spent on a page, access times and other information about your use of, and actions on, our Site. If you access our Site using a mobile device, we also collect device IDs, as well as other information about your device, including without limitation, your wireless carrier, the make, model, operating system, capacity and settings of your device.
d. Cookies. We may collect information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.
e. Pixel Tags. In addition, we use “pixel tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel tags are tiny graphic images with a unique identifier, similar in function to cookies, that are used to track online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, pixel tags are embedded invisibly in Web pages. Pixel tags also allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to a user.
III. Use of Personal Information
We and our authorized service providers may use Personal Information and other non-personal information that we collect from you, or your computer or device, as follows:
a. To operate, maintain, analyze and improve our sites, products, and services.
b. To conduct market and audience analysis.
c. To verify your identity and any information you provide in connection with a factoring application, conduct credit, banking, vendor and criminal background checks and otherwise determine your eligibility for funding.
d. To respond to your requests for funding estimates or consultations or other requests or questions, and to provide customer service, including through emails, live or prerecorded calls or text (SMS) messages directed to any telephone number or email address you provide (including through the use of automatic telephone dialing technologies).
e. To perform the processing and collection of your funding transaction if we approve you for funding.
f. To send you information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.
g. To communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners.
h. To link or combine such information with other Personal Information.
i. To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
j. To provide and deliver products and services at your request.
k. For other purposes that we disclose at the time of collection or otherwise pursuant to your consent.
IV. Sharing of Personal Information
We may share your Personal Information as follows:
a. With Your Consent. We may share your Personal Information with your consent. For example, you may authorize us to share your Personal Information with others for their own marketing uses. Those uses will be subject to their privacy policies.
f. Third Party Service Providers. We may share information with those who need it to do work for us. For example, we may share your Personal Information with third party service providers to provide you with the services that we offer you through our Site, to evaluate and process your requests for quotes and applications for funding (e.g., for conducting a background check, etc.), to provide technical support, and/or to provide other services to the Company. We may also disclose your Personal Information, and information about our transactions with you, with credit bureaus.
V. Creation and Use of Anonymous Information.
We may create Anonymous Information records from Personal Information by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Information to analyze request and usage patterns so that we may enhance the content of our services and improve Site navigation. We reserve the right to use any Anonymous Information and aggregated and other de-identified information for any purpose, and to disclose Anonymous Information to third parties in our sole discretion for their uses.
VI. How We Respond to Do Not Track Signals.
We do not currently respond to “do not track” signals or other mechanisms that might enable users to opt out of tracking on our Site.
VII. Information Changes and Choices
b. You may send requests to update your Personal Information to the email address specified in our Contact Information below.
c. You can typically remove and reject cookies from our Site with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Site works for you and you may not be able to use all of the functionality of our Site.
VIII. Security, Retention and Storage of Information:
a. We use physical, administrative and technical safeguards to help protect the Personal Information that we collect. No security system is impenetrable, however. We cannot guarantee the security of our databases, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the Internet.
